SERVICE AREA


The above rates apply to service in Camden County, Miller County, and Morgan County Missouri. Service rates to other counties in Missouri will be determined on a case-by-case basis.

TIMELY SERVICE


Fairness dictates that papers are served in the order in which they are received. By allowing at least five working days for service, gives us a reasonable chance to effect service and is fair to the defendant and witness being served. When combining writs for service, that have different due or return dates, service will be attempted until the first applicable due date.

PRAECIPES

Writs received without praecipes cause unnecessary delays by forcing us to search the body of the document for service information.
Please specify the attachments on the praecipe, so that we can determine when all additional papers or attachments have been received and the writs can be combined and routed ofr service. Failing to do this can result in delays that reduce the chances for successful service.
Please include complete and accurate service information. If you have old or inaccurate information, the chances of successful service is reduced. For the safety of our staff, please include information if the defendant:
  • Has a history of violence
  • Has a history of mental instability
  • Has a history of alcohol or drug abuse
  • Has a history of weapon offenses and/or
  • Has a communicable or infectious disease

COPIES OF DOCUMENTS

Please provide an extra copy of each document to be used by us when making a return.

SERVICE AT POST OFFICE BOXES

We cannot serve defendants at Post Office Boxes.

SERVICE AT RURAL ROUTES

We cannot serve defendants at rural route addresses without accurate, detailed directions to the house in question.

SERVICE AT PLACE OF EMPLOYMENT

If the defendant is to be served at his place of employment, please provide accurate information as to the defendants specific job site, and hours of work.

MANNER OF SERVICE

You must specify "Personal Service", "Residence Service", or "Custodian Of Records", on the praecipe. If the need arises, we will supply you with all the information available to us that may assist you to file a motion for alternative service. We will not leave a summons or other writ at an avoiding defendant's residence in the hope that he or she will appear. We only serve process according to law.

DIFFICULTY IN SERVICE

If you know a defendant is going to be difficult to serve, or has a history of avoiding service, please provide as much information as possible, to include:
  • Complete defendant personal information, including:
    • Middle Initial
    • Date of birth
    • Social Security Number
    • Last known address; and
    • Place of employment
  • Physical description, to include:
    • Current Photograph
    • Race
    • Age
    • Weight
    • Height
    • Hair Color
    • Glasses
    • Facial Hair
    • Scars
    • Marks and or Tattoos
  • Vehicle Description to include:
    • Year
    • Make
    • Model
    • Color(s) and
    • License number
In the course of our service attempts, we often develop leads on where a defendant may be, or have questions as to how to proceed with service, when all leads and service information has been exhausted. Under these circumstances, we will contact you for further instructions.

INVESTIGATIONS RELATING TO SERVICE

If you determine that you desire us to conduct an investigation to locate the defendant or witness concerning the service of the document, the normal rate is $65.00 per hour, plus expenses.

DEFENDANTS ENTERING VOLUNTARY APPEARANCES

Please notify us as soon as possible when a defendant we are attempting to serve enters a voluntary appearance, so that we can cancel our service attempts.

CHECKING FOR STATUS OF SERVICE

Telephone (573)552-5249 between 9:00 a.m. and 5:00 p.m. Be sure to have the docket and page of the action, and/or the correct spelling of the defendant's name as it appears on the writ(s).
Please do not refer to your client(s) to contact us for the status of the service of documents, as these conversations often evolve into requests for legal advice or for comparisons between what the client believes his or her attorney should be doing and what other attorney's do under similar circumstances, etc. We do not provide legal advice or information to plantiffs, witnesses or defendants.

BILLING

With new clients, pre-payment and mileage is expected for service, not issued through the court. With established clients, we will invoice you after service, or return of the document at the above listed rates. To avoid the embarrassment and the inconveniance of being placed on "advance payment only status", for slow or delinquent payments, please pay promptly when billed.
